In New Hampshire, real estate agents are required to disclose, in writing, who they represent. By law, the agent doesn't represent you, the buyer, until you agree to hire the agent by signing a formal buyer's agency agreement. If the agent represents the seller, everything you say can be carried back to the seller, thereby helping the seller make a better and more informed decision about how to deal with your offer. This can cause you to lose serious leverage in negotiating your offer to purchase.
